TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CITA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNTS YOU PAID US DIRECTLY FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (IF ANY).

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

7. Indemnity

You agree to defend, indemnify, and hold harmless CITA and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

8. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and share information, including in connection with advertising.

9. Changes

We may modify these Terms at any time by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms.

10. Governing law and venue

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. You agree to submit to the personal jurisdiction of the state and federal courts located in Delaware for any disputes arising out of or relating to these Terms or the Site, subject to any rights you may have under mandatory consumer protection laws in your jurisdiction.
